By accessing or using the RankDraft platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

By creating an account, you represent that you are at least 18 years old and that you have the legal authority to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

RankDraft is an AI-powered content strategy platform that provides keyword research, competitor analysis, content planning, automated content production, and performance tracking services. The Service uses artificial intelligence and third-party data sources to analyze search engine results, generate content, and track keyword rankings.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

3. User Accounts

To access certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You agree to provide accurate, current, and complete information during the registration process and to keep such information updated. We reserve the right to suspend or terminate your account if any information provided is inaccurate, outdated, or incomplete.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights
• Generate or distribute content that is unlawful, defamatory, abusive, or otherwise objectionable
• Attempt to gain unauthorized access to the Service, other accounts, or related systems or networks
• Use the Service to send spam, bulk unsolicited messages, or misleading content
• Reverse engineer, decompile, or disassemble any portion of the Service
• Resell or redistribute the Service without prior written authorization from RankDraft
• Use automated bots or scripts to access the Service beyond the provided API, unless expressly permitted

5. Intellectual Property

The Service, including its original content, features, and functionality, is owned by RankDraft and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Content generated by the Service on your behalf is yours. You retain all rights to articles, briefs, and other output produced through the platform. However, you grant RankDraft a non-exclusive, royalty-free license to use anonymized and aggregated data derived from your usage to improve the Service.

Keyword data, SERP analysis, and ranking information provided through the Service are sourced from third-party providers and are subject to their respective terms and conditions.

6. Payment & Subscriptions

Certain features of the Service require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis, depending on the plan you select. All fees are non-refundable except as required by law.

We may change subscription fees upon 30 days' notice. Continued use of the Service after a fee change constitutes acceptance of the new pricing. You may cancel your subscription at any time, and cancellation will take effect at the end of the current billing period.

7. Limitation of Liability

To the fullest extent permitted by applicable law, RankDraft and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use of or inability to use the Service
• Any content generated by the AI, including errors or inaccuracies in generated articles or keyword data
• Unauthorized access to or alteration of your data
• Any third-party conduct or content on or through the Service

In no event shall RankDraft's total liability to you exceed the amount you have paid to RankDraft in the twelve (12) months preceding the event giving rise to the claim.

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.

You may request deletion of your account at any time by contacting us. Upon account deletion, we will remove your personal data in accordance with our Privacy Policy. Aggregated and anonymized data may be retained.

9. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.
